To make an application for unfair dismissal remedy, you must be:

You will get super contributions from your employer if you are:
- 18 years old and over and
- Earning $450 or more before tax every month.
Your employer will contribute to your super fund every 3 months in addition to what you earn. If your employer is not paying into the correct super fund, you should:
- Clarify with your employer that the super isn’t being paid.
- Check your nominated super fund to confirm that no super has been paid. You can call them.
- Lodge an enquiry with the Australian Tax Office.

What superannuation fund should I get?
You can choose to have your super paid into your nominated super fund or your employer’s fund. Your employer must offer you to receive contributions into your personal super fund.
To make a choice on which super fund to get, you should speak to your financial advisor to discuss what you wish to get out of the fund and what investment decisions you wish to get.
If you don’t have a prior super fund, you can elect to go along with the super fund of your employer. You can change your mind later if you want to put your contributions in another fund.
